JHE Haul Platform Hauler Agreement
Independent Contractor, Marketplace Participation & Non-Circumvention Agreement
Company: JHE HAUL, operated by J Hunter Enterprises Inc. ("Company")
Platform: JHE HAUL mobile and web application ("Platform")
User: Independent junk removal service provider ("Hauler")
Effective Date: Upon account registration
1. Legal Acceptance
By creating an account, logging in, bidding on a job, or accepting a job through the Platform, the Hauler agrees to this Agreement.
These actions constitute a legally binding electronic signature under the Electronic Signatures in Global and National Commerce Act (15 U.S.C. ยง7001).
If the Hauler does not agree, they must not use the Platform.
2. Age Eligibility & Qualification Requirements
You must be at least 18 years old to register as a Hauler or use the Platform in any capacity.
By creating a Hauler account, the Hauler represents and warrants that:
- They are at least 18 years of age
- They possess a valid driver's license as required by law for the operation of their vehicle(s)
- Their vehicle(s) carry current and valid registration as required by applicable law
- They maintain insurance coverage that is legally required for the operation of their vehicle(s) and for the hauling/removal services they perform
- They are legally authorized to perform hauling, moving, and junk removal services in their service area
- They have reviewed and comply with all local, state, and federal laws governing the hauling and disposal of materials in the jurisdictions where they operate
Disclaimer โ No Verification by JHE HAUL: JHE HAUL does not independently verify, certify, or guarantee any Hauler's driver's license, vehicle registration, insurance coverage, legal compliance, or authorization to perform services. Haulers are responsible for maintaining all required credentials. Customers use Hauler services at their own discretion.
Accounts created by individuals under 18 are prohibited and will be terminated upon discovery.
3. Independent Contractor Status
The Hauler is an independent contractor and not an employee, agent, partner, or representative of the Company.
The Company:
- Does not hire the Hauler
- Does not supervise work
- Does not control job performance
- Does not provide equipment or labor
- Does not guarantee jobs
The Hauler alone is responsible for:
- Licenses
- Insurance
- Taxes
- Workers
- Vehicles
- Disposal compliance
- All applicable laws
4. Hauler Operations, Safety & Compliance
The Hauler assumes full and sole responsibility for all aspects of their operations, including but not limited to:
- Vehicle safety and maintenance โ ensuring vehicles are roadworthy and compliant with applicable safety standards
- Operational safety โ protecting themselves, their workers, customers, and the public during all service activities
- Insurance โ maintaining adequate auto, liability, and any other insurance coverage required by law or reasonably necessary for their services
- Legal compliance โ adhering to all applicable local, state, and federal laws, including waste disposal, environmental, labor, and transportation regulations
- Licensing and permits โ obtaining and maintaining any business licenses, hauling permits, or professional certifications required in their jurisdiction
- Worker safety โ providing a safe working environment for any employees, helpers, or subcontractors they engage
JHE HAUL is not responsible for any incidents, injuries, accidents, property damage, fines, violations, or legal liability arising from a Hauler's operations.
5. Platform Role
JHE HAUL is a technology marketplace only that connects customers with independent haulers.
The Company is NOT:
- a junk removal company
- a moving company
- a contractor
- a subcontractor
- a carrier
The service contract exists solely between the Customer and the Hauler.
6. In-App Communication Requirement
All communication must occur inside the Platform.
The Hauler shall not:
- Exchange phone numbers
- Exchange emails
- Leave business cards
- Provide outside contact information
- Direct the customer off the app
7. Non-Circumvention
The Hauler may not bypass the Platform.
The Hauler shall not perform services outside the Platform for any customer introduced through JHE HAUL.
This applies:
- During use of the Platform
- For two (2) years after leaving the Platform
Includes:
- Repeat customers
- Property managers
- Referrals
- Associated persons
Cancelling a job in the app and completing it privately is circumvention.
8. Liquidated Damages
Violation of Section 7 results in:
$2,500 per violation OR three (3) times the job value, whichever is greater.
The Company may also:
- Remove the Hauler
- Restrict access
- Seek legal enforcement
9. Booking Fee, Bid Acceptance & Customer Payment
Hauler Bid
The Hauler submits a price ("Bid") for a job through the Platform. The Bid represents the total service price the Hauler is willing to perform the job for.
The Company does not set or control the Hauler's price.
Customer Booking Fee (Platform Fee)
When a customer accepts a Hauler's Bid, the customer must pay a required booking/platform fee to the Company in order to reserve the job.
The booking fee:
- Is paid directly to JHE HAUL
- Is not payment for junk removal services
- Is a technology access, scheduling, and lead-generation fee
- Is deducted from the Hauler's total Bid price
The Hauler has no control over the platform fee amount.
The booking fee is generally non-refundable except if:
- The Hauler cancels the job, OR
- The Company cannot provide a hauler for the scheduled service
Remaining Balance Paid to Hauler
After the job is completed, the customer pays the remaining balance of the Hauler's Bid directly to the Hauler.
The Company:
- Does not collect the hauling payment
- Does not hold hauling funds
- Does not distribute hauling funds
- Is not an escrow agent
The Hauler is solely responsible for:
- Collecting the remaining payment
- Refunds
- Disputes
- Receipts
- Taxes
No Payment Obligation Owed by Hauler to Company
The Hauler does not pay the platform fee and never owes payment to the Company for a completed job.
The platform fee is paid solely by the customer as a booking and lead reservation fee associated with the Hauler's accepted Bid.
10. Account Termination
The Company may suspend or terminate the Hauler for:
- Complaints
- Fraud
- Safety issues
- Harassment
- Off-platform contact
- Circumvention
11. Liability Disclaimer
JHE HAUL is not responsible for:
- Property damage
- Injury
- Disposal legality
- Hauler conduct
- Worker actions
- Job performance
All risks belong solely to the Hauler performing services.
12. Indemnification
The Hauler agrees to indemnify and hold harmless JHE HAUL and J Hunter Enterprises Inc. from any claims, damages, lawsuits, or liabilities arising from the Hauler's services.
13. Governing Law
This Agreement is governed by the laws of the State of Minnesota. All disputes must be brought in Minnesota courts.
14. Digital Signature
By clicking "Create Account" or "I Agree", the Hauler provides a legally enforceable electronic signature equivalent to a handwritten signature.
15. Modifications
The Company may update this Agreement at any time. Continued use of the Platform constitutes acceptance.
When you check the Hauler Agreement box during account setup, you are representing and warranting all of the following:
- I am at least 18 years old
- I possess a valid driver's license for the vehicle(s) I use to haul
- My vehicle(s) have current, valid registration as required by law
- I carry insurance required by law for my vehicle(s) and hauling operations
- I am an independent contractor, not an employee of JHE HAUL
- I am legally authorized to perform hauling, moving, and junk removal services in my service area
- I assume full responsibility for my vehicles, operations, safety, compliance, and insurance
- I understand that JHE HAUL does not verify my licensing, insurance, or legal compliance
- I have read and agree to this Hauler Agreement in full
