JHE Haul Customer Terms of Service
Property Removal Authorization & Liability Waiver
Company: JHE HAUL, operated by J Hunter Enterprises Inc. ("Company")
Platform: JHE HAUL mobile and web application ("Platform")
User: Customer requesting junk removal services ("Customer")
Effective Date: Upon job request or account creation
1. Acceptance of Terms
By creating an account, posting a job, requesting service, scheduling an appointment, or communicating with a hauler through the Platform, the Customer agrees to these Terms of Service.
Selecting "I Agree," "Book Job," or similar confirmation constitutes a legally binding electronic signature under the Electronic Signatures in Global and National Commerce Act (15 U.S.C. §7001).
If the Customer does not agree, they must not use the Platform.
2. Age Eligibility & Account Requirements
You must be at least 18 years old to create an account or post jobs on the Platform.
By creating an account or posting a job, the Customer confirms that:
- They are at least 18 years of age
- They have the legal capacity to enter into a binding agreement
- All information they provide is accurate, truthful, and complete
The Customer is solely responsible for providing accurate job information, including but not limited to:
- A complete and correct description of items to be removed
- Accurate pickup address and ZIP code
- Accurate photos of the items to be hauled
- Any special access requirements, hazards, or conditions at the job site
JHE HAUL reserves the right to suspend or terminate any account where inaccurate information is provided. The Customer assumes full responsibility for any consequences arising from inaccurate or misleading job postings.
Accounts created on behalf of a minor, or by users under 18, are prohibited and will be terminated upon discovery.
3. Platform Role (Very Important)
JHE HAUL is a technology marketplace that connects Customers with independent junk removal service providers ("Haulers").
The Company:
- Does NOT perform junk removal
- Does NOT employ the hauler
- Does NOT supervise the job
- Does NOT transport or dispose of property
All junk removal services are performed by independent haulers, not by JHE HAUL.
The service contract exists solely between the Customer and the Hauler.
4. Property Removal Authorization
By posting a job and scheduling service, the Customer represents and warrants:
- They are the legal owner of the property to be removed OR
- They have full legal authority and permission from the owner to authorize its removal.
The Customer grants permission for the hauler to remove, haul away, and dispose of all items identified in the job listing, photographs, or present at the service location and designated for removal.
Once removed, items may be:
- Disposed
- Donated
- Recycled
- Resold
- Destroyed
Removed items cannot be returned.
5. Wrong Item / Theft Claim Protection
The Customer acknowledges:
Junk removal is irreversible.
The Customer is solely responsible for ensuring all items they wish to keep are removed from the removal area prior to the hauler's arrival.
JHE HAUL and the Hauler are not responsible for accidentally removing items left within the designated junk area.
The Customer waives any claim for:
- Theft
- Conversion
- Loss of sentimental value
- Mistaken removal
after the hauler removes the items.
6. Tenant, Landlord & Third-Party Property
If the job involves:
- A rental unit
- Foreclosure
- Eviction
- Storage unit
- Estate cleanout
- Shared residence
The Customer affirms they have legal authority to order removal of the property.
The Customer agrees to indemnify and hold harmless JHE HAUL and the Hauler from any claims made by:
- Tenants
- Former tenants
- Family members
- Roommates
- Property owners
- Third parties
regarding removed items.
7. Hazardous Materials
The Customer agrees NOT to include:
- Chemicals
- Paint
- Oil
- Gasoline
- Propane tanks
- Ammunition
- Weapons
- Explosives
- Biohazard waste
- Medical waste
- Asbestos
- Any illegal material
The Hauler may refuse service if hazardous materials are present.
The Customer is responsible for any damages or penalties resulting from undisclosed hazardous materials.
8. Booking Fee / Deposit
To reserve a scheduled appointment, the Customer must pay a booking fee to JHE HAUL through the Platform.
The booking fee:
- Is a platform scheduling and lead-generation fee
- Is NOT payment for junk removal services
- Is credited toward the total service price
- Is generally non-refundable
Refunds are issued only if:
- The Hauler cancels the job, OR
- No hauler is available and the Company cannot fulfill the service
9. Payment to Hauler
The Customer pays the remaining balance directly to the Hauler after the job is completed.
JHE HAUL:
- Does not collect hauling payment
- Does not hold funds
- Does not process hauling transactions
- Is not responsible for pricing disputes
All pricing disputes must be resolved directly with the Hauler.
10. Liability Disclaimer
To the fullest extent permitted by law, JHE HAUL is not liable for:
- Property damage
- Personal injury
- Cleanup quality
- Disposal decisions
- Hauler behavior
- Scheduling issues
- Missed appointments
11. Limitation of Damages
The Company's maximum liability, if any, shall not exceed the amount of the booking fee paid by the Customer.
12. Indemnification
The Customer agrees to defend, indemnify, and hold harmless JHE HAUL and J Hunter Enterprises Inc. from any claims, lawsuits, damages, or losses arising from:
- Property ownership disputes
- Unauthorized removal claims
- Third-party ownership claims
- Hazardous materials
- Misrepresentation of authority
13. Governing Law
These Terms are governed by the laws of the State of Minnesota.
Any dispute shall be brought exclusively in Minnesota courts.
14. Digital Signature
By selecting "I Agree" or "Book Job," the Customer provides a legally binding electronic signature and agrees this is equivalent to signing a written contract.
When you check the agreement box and submit a job, you are confirming all of the following:
- I am at least 18 years old
- I have the legal capacity to enter into a binding agreement
- All job information I have provided is accurate and complete
- I am the legal owner of the items to be removed, or have full legal authority to authorize their removal
- I understand that removed items cannot be returned
- I have read and agree to the JHE Haul Customer Terms of Service in full
